Tao Group Hospitality Rewards Terms & Conditions

By participating in the Tao Group Hospitality Rewards Program (hereinafter, the “Program”), you agree to be bound by these terms and conditions (“Terms”), including, without limitation, the arbitration agreement and class action waiver included below. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE TAO GROUP HOSPITALITY PROGRAM.
- Program Overview
- One (1) reward point (“Rewards Point”) is earned for each dollar spent (excluding tax, any fees and tip) at our participating U.S. locations (see Section 4, herein for a list of non-participating locations).
- Rewards Points will be automatically added to your Rewards account (“Account”) within 24 hours of your visit.
- Rewards Points may be earned for dining, nightlife, daylife, private events, delivery (where applicable), ticket purchases (where applicable) and gift card redemptions.
- You may earn a maximum of 10,000 Rewards Points per visit to a participating U.S. location, regardless of purchase amount. You will automatically receive ten (10) rewards dollars (“Rewards Dollars”) for every 200 Rewards Points you accrue.
- Restrictions
- Rewards Points are not valid in conjunction with any other offers, discounts, or Tao Group Hospitality promotional/comp cards.
- Rewards Points are not earned for physical gift card or e-gift card purchases.
- Rewards Points cannot be earned retroactively.
- Tao Group Hospitality reserves the right to specify blackout dates, without notice, for earning Rewards Points and redeeming Rewards Dollars. Please check with the venue for specific dates prior to visiting.
- Rewards Dollars cannot be redeemed as payment for private parties, catering, or purchase of gift cards.
- Tao Group Hospitality reserves the right to cancel or suspend Accounts due to inactivity, suspicion of fraud or any inappropriate activity (in Tao Group Hospitality’s sole discretion) on a member’s Account. Upon termination or cancellation of an Account for any reason, all Rewards Points and/or Reward Dollars (if any) shall automatically be forfeited.
- Rewards Points & Rewards Dollars Expiration
- Rewards Points expire 365 days from your last visit and Rewards Dollars expire 365 days from the date of their accrual.
- Certain Rewards, such as birthday or anniversary rewards, will only be valid for a limited time.
- To determine when your Rewards Dollars expire, please check your Account inside the Tao Group Hospitality mobile app.
- Non-Participating Locations
- The following U.S. location(s) do not participate in the Rewards Program:
- Las Vegas – Marquee Nightclub & Dayclub, Jewel, Wet Republic, Stanton Social Prime, Egghead, Liquid, and Casa Calavera
- Miami – Hakkasan, Casadonna
- Waikiki – Herringbone
- New York – Suite Sixteen
- Connecticut – TAO Mohegan Sun
- Locations where otherwise prohibited by law with respect to earning and redemption of Rewards Points on alcohol or non-alcohol sales.
- Locations outside of the continental United States.
- The earning and redemption of Rewards Points is limited to non-alcohol sales at California locations.
- Eligibility
- The Program is open to legal residents of the United States who are eighteen (18) years or older at the time of enrollment. The Program is void where prohibited by law. Employees of Tao Group Hospitality and any of its affiliates, parent companies, management companies, or anyone affiliated in any way with Tao Group Hospitality are not eligible to participate in the Program.
- Enrolling in the Program
- To participate in Tao Group Hospitality’s Rewards Program, you must download the Tao Group Hospitality mobile app, available on iOS & Android. Once you have downloaded the app, create an Account. Then log in on the app, utilize the check-in feature and link your Account to your check or bar tab.
- An individual must have a unique, valid email address to create an Account. The individual who is the authorized email account holder of the email address indicated when registering must provide date of birth information when registering for an Account and will be deemed the enrollee. An individual may enroll in only one Account. All registration information shall be maintained in accordance with the terms of Tao Group Hospitality’s Privacy Policy, available at https://taogroup.com/privacy-policy/, which is incorporated herein by reference.
- Earning Rewards Points
- Generally: Tao Group Hospitality reserves the right to change, add, or remove the methods by which Reward Points can be earned, at its discretion, at any time.
- When Visiting a Participating Location: To redeem Rewards Points, log into the Tao Group Hospitality App and ask your server or bartender for your check number. This will link your Account to the check.
- To earn Rewards Points when hosting a party or private event, you must be a Tao Group Hospitality Rewards member prior to the event date. You will receive one (1) Reward Point per dollar spent on food and beverage purchases only (before tax and gratuity). The name of the person receiving Rewards Points must also appear on the event agreement.
- Restaurant Delivery (where applicable): Rewards Points may only be earned for delivery, at participating locations through our delivery partners where applicable. If Rewards are available, during the ordering process you must add a specific item to your order and follow the onscreen instructions to leave the necessary info to link your Account. This item must be included in the original delivery order to earn Rewards. Unfortunately, Reward Points may not be earned retroactively. You will receive one (1) Reward Point per dollar spent on food and beverage purchases only (before tax and gratuity).
- Online Ticket Purchases (where applicable): If available on the event, you can earn Rewards Points for online ticket purchases through our preferred ticket partners Ticket Sauce & Ticket Driver. Follow the instruction listed on each event details page in order to properly link your Rewards account. Rewards Points are not granted retroactively on purchases. You will receive one (1) Reward Point per dollar spend for online ticket purchases (excluding taxes, online service fees, box office service fees, administrative fees, processing fees and gratuity).
- Nightlife/Daylife Online Table Packages: You can earn Rewards Points from your online Table Package. Once at the venue, speak to your host or server or who will link your check to your Account. Table packages booked online are not automatically linked during the online checkout process and must be linked in person. Your Account must be linked prior to paying for your check.
- Gift Cards: Rewards Points can be earned when a gift card is redeemed, but not when it is purchased. You may not use Rewards Dollars to purchase a gift card.
- Reward Points have no cash value and cannot be redeemed for cash. Rewards Points cannot be transferred or assigned, except as specifically permitted by Tao Group Hospitality on the Website from time to time.
- Redeeming Rewards Dollars
- Rewards Dollars can only be redeemed when visiting a participating location. When you are ready to pay, there are two ways to redeem Rewards Dollars. If you choose the Mobile Pay feature, you will be prompted to specify how many Rewards Dollars you would like to redeem during your visit. If you choose to pay traditionally, you will need to inform your server or bartender that you would like to redeem Rewards Dollars. Please note, with traditional payment method, all your available Rewards Dollars will be redeemed.
- You may redeem Rewards Dollars for food and drink items, where permitted by law. All Rewards Dollars redemptions are final. All redemptions are subject to these Terms and all limitations and/or requirements.
- Account Activities
- You are responsible for ensuring the accuracy of your Account and is encouraged to check your Account regularly. You are responsible for ensuring that the information associated with your Account is accurate and up to date. Changes to your Account or Account information may only be made by you to whom the Account belongs.
- Modifications and Termination of the Program
- Tao Group Hospitality reserves the right to modify any of the Terms and Conditions set forth herein – including, but not limited to, methods by which Rewards Points can be earned, and the number of Rewards Dollars that may be redeemed through the Program, and any of the options made available to you with respect to your Account, at any time, with notice, even though these changes may affect an your ability to accrue Rewards Points or use your Rewards Dollars. Tao Group Hospitality reserves the right to terminate the Program or temporarily suspend the Program at any time, for any reason, upon thirty (30) days’ prior notice, even though termination may affect your ability to accrue Rewards Points or use Rewards Dollars. In the event of termination, your will have thirty (30) days from date Program termination is announced to redeem unused Rewards Dollars.
- Your continued participation in the Program constitutes your acceptance of any changes to these Terms. You are responsible for remaining knowledgeable of any changes that Tao Group Hospitality may make to these Terms. The most current version of these Terms, which will indicate the date they were last updated, will be available at the Tao Group Hospitality website and will supersede all previous versions of these Terms.
- General Terms and Conditions
- To learn how the personal information collected in connection with the Program may be used, participants should read Tao Group Hospitality’s Privacy Policy at https://taogroup.com/privacy-policy/. Tao Group Hospitality reserves the right to discontinue the participation privileges of any individual who engages in any fraudulent activity or uses the Program in a manner inconsistent with these Terms or who violates any federal, state or local, laws, statutes or ordinances. Discontinued participation privileges may result in the loss of all accumulated Rewards Points and/or Rewards Dollars. In addition, Tao Group Hospitality shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.
- Tao Group Hospitality reserves the right to rescind Rewards Points credited to an Account which were obtained as a result of fraudulent activity or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software related to the Program.
- The Program is provided to individuals only. Corporations, associations or other groups may not participate in the Program. It is fraudulent for any individual or company, association, or group to direct, encourage, or allow individuals to use a single Account for the purpose of accumulating Rewards Points and/or Rewards Dollars for combined use.
- Rewards Points are not your property and may be revoked at any time by Tao Group Hospitality as set forth herein.
- Tao Group Hospitality is not responsible for any incorrect or inaccurate information supplied at time of enrollment.
- All questions or disputes regarding eligibility for the Program, earning Rewards Points and/or redemption of Rewards Dollars, or your compliance with these Terms will be resolved by Tao Group Hospitality in its sole discretion.
- You consent to receive communications from Tao Group Hospitality electronically, either by e-mail or by notices posted on its website, as determined by Tao Group Hospitality in its sole discretion.
- Deletion of the app does not delete your Rewards Account. Should you wish to delete your Account in its entirety, you may request to do so in the “Account” section of the app.
- Limitation of Liability
- Tao Group Hospitality, its parent, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, agents and employees (collectively, “Released Parties”) are not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with the Program or utilized by an enrollee, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network, cellular network, or electronic transmission, for problems relating to computer equipment, software, inability to access the website or online service, or for any other technical or non-technical error or malfunction. Released Parties are not responsible for late, lost, incomplete, delayed, inaccurate, garbled, undelivered, misdirected Rewards Points, purchases, redemptions or communications of any kind or other errors or problems of any kind relating to or in connection with the Program, whether printing, typographical, technical, computer, network. human, mechanical, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Program, the tabulating of Rewards Points or Rewards Dollars, the redemption of Rewards Dollars, or in any Program-related materials. Program is not valid with in combination any other programs offered by Tao Group Hospitality. By participating in the Program, you agree (i) to release, discharge, indemnify and hold harmless Released Parties from any liability or damages which may arise out of participation in the Program. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF THE TAO GROUP HOSPITALITY IMPROPERLY DENIES YOU ANY REWARDS POINTS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT NUMBER OF REWARDS POINTS. BY PARTICIPATING IN THE PROGRAM, YOU WAIVE ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.
- As a condition of participating in this Program, you agree that (1) any and all disputes, claims, and causes of action arising out of or connected with this Program, or any Rewards Dollars obtained through the Program, shall be resolved individually, without resort to any form of class action and exclusively by arbitration under the International Arbitration Rules of the American Arbitration Association. Arbitration will take place in the Borough of Manhattan, New York, New York; (2) any and all claims, judgments and rewards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Program, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to seek recovery for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and waive any and all rights to have damages multiplied or otherwise increased.
- All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms, or the rights and obligations of enrollees and Tao Group Hospitality in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of New York.
- These Terms constitute the entire agreement between you and Tao Group Hospitality pertaining to the subject matter hereof and supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Terms shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.
- If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms, which will otherwise remain in full force and effect.
